Passport Endorsements

8 FAM 505.2-1  Endorsement Code Procedures

a. “Endorsement” means an official stamped, typed, or written indication of the circumstances under which a passport was issued or can be used.  The bearer may also be provided with an information notice (IN) that provides more information on the endorsement.  Endorsed passports indicate that:

(1)  They are valid only for a specific period of time;

(2)  The bearer has a certain status; and/or

(3)  There is some other relevant information about the bearer of the passport.

b. Supervisory consular officers abroad and directors of passport agencies and centers must ensure that endorsements are processed correctly.  You must use the standard wording given for each endorsement.  Do not modify the endorsement text unless specifically authorized by:

(1)  Passport Services (CA/PPT) for passport agencies and centers;

(2)  CA/PPT or Overseas Citizen Services, American Citizen Services (CA/OCS/ACS) for posts; and

(3)  The Special Issuance Agency (CA/PPT/SIA) for special issuance passports. 

c.  You must use the specific endorsement prescribed for the situation at hand and avoid the indiscriminate use of general endorsements such as Code 46.  The use of a nonstandard endorsement or incorrect use of a standard endorsement may cause confusion, problems for the traveler, or inappropriate action in subsequent adjudication.  Uniform use of endorsements will avoid such confusion, and minimize the need to retrieve and review previous passport files.

d. Specific guidance about the use of endorsements is provided in the corresponding subject instructions in 8 FAM.  The endorsement code must be noted in the appropriate space on the passport application.

e. See 8 FAM 706.1 for specific information on using endorsements with passport cards.

f.  If a passport book contains two or more endorsements, e.g., endorsements 73 and 75, that limit its validity period:

(1)  For regular passport books, the validity period is equal to the minimum length of time provided in this subchapter.  For example, if one endorsement limits the passport book to one year, and the second limits it to two years, the passport book would be issued with a one-year validity period; and

(2)  Special-issuance passports must be limited only with regard to the applicant's entitlement to the special issuance passport:

(a)  All issues should be resolved prior to the issuance of a special-issuance passport.  For example, an applicant who did not submit an acceptable U.S. birth certificate must submit an acceptable birth certificate before being issued a special-issuance passport; and

(b)  CA/PPT/SIA may authorize exceptions to this policy in special, emergency circumstances and limit the passport book for an appropriate period of time to meet U.S. Government objectives.

f.  The total length of the endorsements in the next generation passport is limited to 900 characters.

g. Unless provided otherwise in this subchapter, U.S. passports (except emergency passports) must be issued for a minimum of one year, even if the passport would otherwise be limited for less than one year, e.g., because of a limited period of entitlement.  The one-year validity period provides sufficient time for the applicant to:

(1)  Receive the passport;

(2)  Obtain all necessary visas;

(3)  Comply with airline carriage requirements;

(4)  Comply with foreign entry/exit requirements; and

(5)  Complete their travel.

h. CA/PPT/SIA may authorize the deletion of an endorsement in a special-issuance passport book if the status granted by the endorsement no longer applies and the applicant will remain entitled to the passport book for a period of time equal to or greater than its current validity.  The special-issuance passport book would then be amended to add the new, correct endorsement (see 8 FAM 1004.1).  Otherwise, the applicant must re-apply and a new special-issuance passport book issued for a period appropriate to the applicant's entitlement.  To delete an endorsement:

(1)  Use a ruler and a black pen to neatly line out the endorsement text; and

(2)  Insert endorsement DEL and the new endorsement (if applicable).

j.  In the next-generation passport, endorsements are printed in the order selected.

To replace a passport canceled in error, a spoiled or defective passport, a passport containing a data error (including incorrect endorsements), or a re-issued form DS-4085 (see 8 FAM 1001.4).  Limit to expiration date of original passport.  (If the passport would be limited to six months or less, you should advise the applicant of entry and transit requirements.)  This endorsement will print the letter "R" on the passport card to indicate that it is a replacement.  Passports limited with endorsement 03 may be replaced on form DS-82 if otherwise eligible.

04 (N)

NO FEE.

Placed in all no-fee regular passports, except dependent passports with preprinted endorsement 60 used by CA/PPT/SIA, the Charleston Passport Center (CA/PPT/CPC), and the Honolulu Passport Agency (CA/PPT/HH).

05 (D)

This endorsement replaces “Linkage Letters” used when a foreign government requires that the applicant provide evidence of continuity of identity.  You may include this endorsement when requested by the applicant.

Use when the first passport is unavailable due to visa processing delay or when a foreign country will deny a visa or entry to the bearer of a passport containing markings or visas showing travel to certain other countries.  Second passport books cannot be extended.

·         Limit regular passport books to four years.

·         Limit diplomatic, official, or no-fee regular passport books to one year less than the expiration date of the current passport book, not to exceed four years.

46 (ALL)

THIS PASSPORT EXPIRES ON (MON DY, YEAR).  IT CANNOT BE REPLACED WITHOUT THE EXPRESS AUTHORIZATION OF THE DEPARTMENT OF STATE.

Special problems, which cannot be resolved before emergency travel.  Limit to one year unless specified otherwise below.  Review file to determine what is needed to replace passport.  May be replaced with a fully-valid passport if acceptable documentation or verification to overcome the problem is submitted within one year from the issuance date of the passport unless specified otherwise below.  For example, this endorsement may be used when:

·        Child traveling abroad before adoption is final.  Enclosure: IN-941-10.

·        Child traveling when original, notarized consent has not been submitted (see 8 FAM 703.7). Enclosure: IN-941-13B.

·        Applicant traveling when original, signed declaration that they have not been issued a Social Security Number has not been received (see 8 FAM 403.5).

·        Unacceptable photographs (see 8 FAM 402.1). Enclosure: IN-941-28.

·        Infant traveling abroad before a name was selected (see 8 FAM 403.1).

·        Authorized exceptions to policy for official and diplomatic passport books.  Limitations will vary on a case-by-case basis not to exceed four years.  Use ONLY when authorized by CA/PPT/SIA.

·        Persons indebted to the U.S. government who have made satisfactory arrangements to repay the loan and are not in default of these arrangements (see 8 FAM 501.5).  Enclosure: IN-941-32.

·        Persons identified by personal discussion with the passport issuing officer for emergency travel (see 8 FAM 401.5).

·        Applicants who have received a material name change but cannot provide acceptable documentation thereof (see 8 FAM 403.1).

·        Applicants with an imminent life-or-death emergency where passport issuance is authorized under 22 U.S.C. 212a or 22 U.S.C. 2714(a) (see 8 FAM 501.5-3(A) and 8 FAM 501.5-13).

Official passports:

·        Military cadets or midshipmen traveling abroad on a temporary duty assignment.  Limit to three years.

·        All eligible family members of military general officers traveling on invitational travel orders accompanying their sponsor on official government business.  Limit to two years.

No-fee regular passports:

·        Next-of-kin of military personnel wounded or ill abroad, or persons traveling abroad to participate in a court-martial -- traveling on invitational orders at government expense.  Limit to one year.  May be replaced on receipt of new travel authorization orders.

Special Validation passports (see 8 FAM 1303.1):

·        Applicants who have been approved for a Special Validation.  Special Validation passports cannot be replaced with a full-validity passport.  Multi-entry Special Validation passports only should be limited to two years instead of one

47 (ALL)

·         The Department has not completed a manual file search (see 8 FAM 1201.1).

·         The applicant’s birth certificate has been filed, but has not been received: i.e., for newborns, if sufficient evidence of relationship to the parent(s) has been submitted.

·         The applicant submitted a birth abstract from an issuing authority in the State of Texas that does not include detailed place of birth information.

·        Applicant does not have their original Certificate of Naturalization or Certificate of Citizenship, is in the process of applying for a new certificate from the Department of Homeland Security, and has an urgent departure date (an applicant for a replacement certificate of citizenship may instead submit evidence that they have U.S. citizenship through the naturalization of a U.S. citizen parent).  The applicant must provide evidence that they have applied for a replacement Certificate of Naturalization (either an original or photocopied form I-797C, "Notice of Action"  (the receipt for the form N-565, "Application for Replacement Naturalization/Citizenship Document") or, if unavailable, a printed copy of case status showing form N-565 acceptance from the USCIS "My Case Status" public website provided by the customer);

·        Verification of naturalization must be received, either:

·        Via the Person Centric Query Service (PCQS) in the Consular Consolidated Database (CCD);

·        A letter of verification of the applicant's naturalization from the United States Citizenship and Immigration Services (USCIS).  The letter must be on office letterhead paper and contain an original signature of a local office director.  The letter must include the applicant's full name and date of birth, date and place of the naturalization, the alien registration number and the naturalization certificate number as shown in USCIS records; or

·        Form GS-24, "Certification of Documents" from the former Immigration and Naturalization Service (INS).

Limit to two years.  May be replaced free-of-charge with a fully-valid passport provided new Certificate of Naturalization/Certificate of Citizenship is submitted within two years from the issuance date of the original passport.

Use in rare instances when applicant has multiple, legal, first, middle, and/or last names listed on the birth evidence, and/or identification documentation that are too long for total inclusion in the passport data page.  TDIS and ACS only allow for a certain set number of characters on the line for given and middle names as well as the line for the surname.  Determine, with input from the applicant, what abbreviated version of the legal name is acceptable to them for inclusion in the passport data page.  This endorsement does not change the name as it appears on a passport card, nor is it printed on the passport card.

·         If the passport is being issued domestically through the overseas photo-digitized passport (OPDP) program, then the code 74 endorsement should be used.

·         Endorsement 112 is only for use by posts abroad issuing an emergency passport.

THIS PASSPORT CANNOT BE EXTENDED BEYOND 5 YEARS.

Bearer was under 16 when application was executed, but reached 16 before issuance of passport approved or when the passport was printed (if there were delays in processing).

A passport with this endorsement cannot be renewed on form DS-82 (22 CFR 51.21).

Although this endorsement is available in TDIS, TDIS instead sets the issue date as the day before the applicant's 16th birthday to avoid issue-date conflicts when the applicant applies for both a passport book and card because the endorsement cannot be printed on the passport card.  This endorsement will change the change of services and payments screen to adult and require a manager override if the application has been in the system over 90 days but still is process.

Do not charge the applicant an execution or passport fee for the following types of cases:

·         Deportation;

·         Repatriation;

·         Prisoner transfer; or

·         When otherwise authorized by the Department under 22 U.S.C. 214(a).

To obtain a full validity passport, the bearer must execute a form DS-11, provide citizenship and identity evidence and pay the execution and passport fees.

Used ONLY by posts.  Limited validity passport for emergency travel.  Limit to 1 year.  Use in the rare instances when applicant has multiple legal given and/or surnames listed on the birth evidence and/or identification documentation that are too long for total inclusion on the passport data page.  TDIS and ACS only allow for a certain set number of characters on the line for given and middle names as well as the line for the surname.  Determine, with input from the applicant, what abbreviated version of the legal name is acceptable to them for inclusion on the passport data page.  Endorsement code 112 is for use only on emergency passports issued by posts abroad.  For OPDP issued domestically, posts should use code 74.  The applicant may re-apply on a form DS-82.

Used ONLY by posts.  Use ONLY when specifically authorized, either by country or on a case-by-case basis, by the Director of CA/OCS/ACS.  This endorsement is used to amend a passport with less than four years validity when the host country refuses to recognize the validity of a visa in a canceled passport.  Using this endorsement will, in effect, make the existing passport a second passport valid for two years or less.  Post may issue a new full validity passport to the applicant.  Use of this endorsement is currently authorized for:

Used ONLY by posts.  Applicant submitted a birth certificate filed by a PFBD attendant that does not meet the requirements necessary to issue a full validity passport, no derogatory information is located, and the applicant has an urgent departure date.  Limit to one year.  May be replaced free of charge on a form DS-5504 provided acceptable citizenship evidence is submitted within one year from the issuance date of the original passport.  Otherwise, the applicant must re-apply on a form DS-11.  If the application for a free-of-charge full validity passport is received domestically, it must be referred to CA/PPT/CPC for adjudication.

Used ONLY by posts.  This endorsement replaces “Linkage Letters” used when a foreign government requires that the applicant provide evidence of continuity of identity.  This endorsement also may be used to amend an existing passport (see 8 FAM 1004.1 and 8 FAM 702.4).

Used ONLY by posts in emergency passports.  Bearer is a covered sex offender per 22 U.S.C. 212b(c)(1) and their passport must be endorsed.  Limit the passport to 1 year.  See also 8 FAM 501.5 regarding name clearance, 8 FAM 803.6 regarding denial and revocation of passports, and 8 FAM 706.1 regarding passport cards, for additional specific guidance on appropriate procedures.
