8 FAM 403.2-1 Adjudicating the Date of Birth

a. If the applicant states that the date of birth (DOB) is incorrect on their birth certificate, you must request either an amended birth certificate or, in urgent circumstances when an amended birth certificate is not available, you may accept additional evidence or documentation (IRL 875-30).
b. If the applicant states that the DOB is incorrect on their naturalization certificate, citizenship certificate, or permanent resident card, they may either request that the passport be issued in the DOB listed on the Naturalization Certificate (nat cert), Certificate of Citizenship (citz cert), or Permanent Resident Card (PRC), or have the nat/citz certificate or PRC amended by U.S. Citizenship and Immigration Services (IRL 879-05).
NOTE: In accordance with the January 16, 2014, Accuracy for Adoptees Act, the passport for a foreign-born adoptee must reflect the DOB used in state court order(s) or state vital record(s) (if any), if the applicant has a foreign adoption decree or foreign birth certificate in a different DOB. |
c. If the applicant claims that the DOB is incorrect on their submitted passport or Consular Report of Birth Abroad, and the mistake can be verified through Passport Information Electronic Records System (PIERS)/American Citizens Record Query (ACRQ), the DOB should be corrected through the PIERS/ACRQ verification (see 8 FAM 1201.1). Otherwise, they must submit acceptable evidence of the correct DOB, such as a U.S. or foreign birth certificate.
