8 FAM 506.4-1 Eligibility for a CRBA for Deceased Children
(CT:CITZ-39; 10-19-2020)
a. Form FS-240, A Consular Report of Birth Abroad of a Citizen of the United States, may be issued in the name of a deceased child born abroad who acquired U.S. citizenship at birth and died before age 18, if requested by the parent(s) or the child's legal guardian. Address questions about such cases to Passport Services' Office of Adjudication at AskPPTAdjudication@state.gov.
b. The form FS-240 may be issued even if a form DS-2060, Report of Death of a U.S. Citizen or U.S. Non-Citizen National Abroad, has already been issued.
c. The parent(s) or legal guardian must still submit all evidence required for the form DS-2029, and pay all applicable fees.
8 FAM 506.4-2 Eligibility for an Official Copy of a CRBA for Deceased Individuals

a. Official copies of a form FS-240 for a deceased individual may be issued to the parent(s)/legal guardian(s) of the deceased individual. The parent(s) must provide evidence of identity, relationship to the deceased individual, and evidence that the subject is deceased (e.g., a copy of the death certificate).
b. Although deceased individuals do not have rights under the Privacy Act, the form FS-240 includes the deceased individual's parent(s) name(s). Consequently, a request for an official copy of the form FS-240 from someone other than the parent(s) should include consent from the parent(s) or evidence that the parent(s) are also deceased.
