a. CAIO Role

(1)  Per OMB M-24-10, the primary role of the Chief Artificial Intelligence Officer (CAIO) is coordination, innovation, and risk management for their agency’s use of AI specifically, as opposed to data or IT issues in general.

(2)  In alignment with Section 6303 of the FY 2023 Department of State Authorization Act, the Department’s Chief Data and AI Officer (CDAO) performs the roles of CAIO and Chief Data Officer (CDO), consistent with 1 FAM 044.

b. CAIO Responsibilities-Executive Order 14110 tasks the CAIO with primary responsibility to coordinate the Department’s use of AI, promote AI innovation, manage risks from the use of AI, and carry out the Department’s responsibilities defined in Section 8(c) of Executive Order 13960 and Section 4(b) of Executive Order 14091. In addition, the CAIO, directly or through designated officials and governance structures, is responsible for:

(1) Coordinating The Use Of AI.

(a)  Per 20 FAM 102, serves as the senior advisor for applied AI to the Secretary and other senior leadership and within the Department’s senior decision-making forums:

(i)     Serves as vice-chair of the AI Governance Board sessions as part of the Enterprise Governance Board (EGB).  The EGB is the executive level body of the Department’s data and AI governance structure, and it is also the Department’s AI Governance Board, in alignment with OMB M-24-10. The EGB is chaired by the Deputy Secretary for Management and Resources.

(ii)    Chairs the Enterprise Data and AI Council (EDAC).  The EDAC is the strategic level body of the Department’s data and AI governance structure, and it is the primary decision-making body on data and applied AI.

(b)  Institutes the requisite governance and oversight processes to achieve compliance with OMB M-24-10 and enables responsible use of AI in the Department through the EGB and EDAC.

(c)  Maintains awareness of Department AI activities, including through the creation and maintenance of the annual AI use case inventory.

(d)  Develops a plan for compliance with OMB M-24-10.

(e)  Works with and advises the Department CFO, Comptroller, and the Director of Budget and Planning on the resourcing requirements necessary to implement OMB M-24-10 and provides recommendations on priority investment areas to build upon existing enterprise capacity.

(f)   Advises the Director General of the Foreign Service and Director of Global Talent and the Director of the Foreign Service Institute on improving workforce capacity and securing and maintaining the skillsets necessary for using AI to further the Department’s mission and adequately manage its risks.

(g)  Shares relevant information with Department officials involved in the Department’s major AI policymaking initiatives.

(h)  Supports Department involvement with appropriate interagency coordination bodies related to their agency’s AI activities, including representing the Department on the Chief AI Officers Council.

(i)   Supports and coordinates the Department’s involvement in AI standards-setting bodies, as appropriate, and encouraging Department adoption of voluntary consensus standards for AI, as appropriate and consistent with OMB Circular No. A-119, if applicable.

(j)   Promotes equity and inclusion within the Department’s AI governance structures and incorporates diverse perspectives into the decision-making process in line with the Department’s DEIA Strategic Plan and Section 4 (b) of Executive Order 14091.

(i)     The language of the latter document requires the Department to design, develop, acquire, and use artificial intelligence and automated systems in a manner consistent with applicable law and that advances equity.

(2) Promoting AI Innovation

(a)  Identifies and prioritizes appropriate uses of AI that will advance both the Department’s mission and equitable outcomes.

(b)  Identifies and removes barriers to the responsible use of AI in the Department, including through the advancement of AI-enabling enterprise infrastructure, data access and governance, workforce development measures, policy, and other resources for AI innovation.

(c)  Works with the CIO and other relevant officials to ensure that custom-developed AI code and the data used to develop and test AI are appropriately inventoried, shared, and released in Department code and data repositories.  The Department must share AI code, models, and data, and do so in a manner that facilitates re-use and collaboration Government-wide and with the public, subject to applicable law, governmentwide guidance, and the following considerations:

(i)     The sharing of the code is restricted by law or regulation, including patent or intellectual property law, the Export Asset Regulations, the International Traffic in Arms Regulations, and Federal laws and regulations governing classified information;

(ii)    The sharing of code would create an identifiable risk to national security, confidentiality of Government information, individual privacy, or the rights or safety of the public;

(iii)    The agency is prevented by a contractual obligation from doing so; or

(iv)   The sharing of the code would create an identifiable risk to agency mission, programs, or operations, or to the stability, security, or integrity of an agency’s systems or personnel.

(d)  Advocates within the Department and to the public on the opportunities and benefits of AI to the Department’s mission.

(3) Managing Risks From The Use Of AI

(a)  Manages a program that supports the enterprise in identifying and managing risks from the use of AI, especially for safety-impacting and rights-impacting AI.

(b)  Works with relevant senior Department officials to establish or update processes to measure, monitor, and evaluate the ongoing performance and effectiveness of the Department’s AI applications and whether the AI is advancing the Department’s mission and meeting performance objectives.

(c)  Oversees Department compliance with requirements to manage risks from the use of AI, including those established in relevant law and policy.

(d)  Conducts risk assessments, as necessary, of the Department’s AI applications to ensure compliance with OMB M-24-10.

(e)  Works with relevant Department officials to develop supplementary AI risk management guidance particular to the Department’s mission, including working in coordination with officials responsible for privacy and civil rights and civil liberties on identifying safety-impacting and rights-impacting AI within the Department.

(f)   Waives individual applications of AI from elements of Section 5 of OMB M-24-10 through the processes detailed in that section.

(g)  In partnership with relevant Department officials (e.g., authorizing, procurement, legal, data governance, human capital, and oversight officials), establishes controls to ensure that their Department does not use AI that is not in compliance with OMB M-24-10, including by assisting these relevant Department officials in evaluating Authorizations to Operate based on risks from the use of AI.

c.  Seniority-The CAIO must be a position at the Senior Executive Service, Scientific and Professional, or Senior Leader level, or equivalent.

d. Position and Reporting Structure-The CAIO must have the necessary authority to perform the responsibilities in this section and must be positioned highly enough to engage regularly with other agency leadership, to include the Deputy Secretary or equivalent.  Further, the CAIO must coordinate with other responsible officials at the Department to ensure that the Department’s use of AI complies with and is appropriate in light of applicable law and governmentwide guidance.  The CAIO may delegate responsibilities to the Deputy CAIO, as needed.
