12 FAM 351  SCOPE AND AUTHORITY

12 FAM 351.1  Policy

The Bureau of Diplomatic Security (DS) develops policies and programs requiring all new construction and renovation projects in facilities abroad under chief of mission (COM) security responsibility to comply with Department security standards for construction, procurement, and transit security of construction materials for controlled access areas (CAAs).  The Bureau of Overseas Buildings Operations (OBO), Office of Security Management (OBO/CFSM/SM), is responsible for implementing these policies and programs.

12 FAM 352  SECURITY STANDARDS

a. DS develops technical intelligence threat level-based security standards for application to construction security, procurement, and transit security of construction materials for new CAA construction and CAA renovation projects (see 12 FAH-6 H-300).  Construction security plans for relevant new construction and renovation projects must apply these standards.

b. OBO/CFSM/SM implements construction security standards for all projects, including those that:

(1)  OBO initiates;

(2)  A tenant agency sponsors and that take place in OBO-controlled space; or

(3)  That a post initiates with OBO funding or OBO procurement assistance.

12 FAM 353  CONSTRUCTION SECURITY SITE SECURITY MANAGER

a. For all new construction and major renovation projects that require Construction Security Certification as defined in 12 FAM 360, OBO, in consultation with DS, assigns a DS-trained and DS-approved, direct-hire employee, Personal Services Contract  employee, or re-employed annuitant  as the site security manager (SSM).  The SSM, in consultation with the OBO project director (PD), has direct responsibility and authority for ensuring the security integrity of the site in accordance with the Construction Security Plan (CSP).  The SSM keeps the PD and the post’s regional security officer (RSO) apprised of all security-related issues.

b. For all other construction and renovation projects that require Construction Security Certification as defined in 12 FAM 360, the post’s RSO is designated as the SSM.  The RSO may delegate day-to-day SSM responsibilities, to include record keeping; however, the RSO retains the overall responsibility for the security of the project in accordance with the CSP.  The RSO is authorized to hold the project in abeyance pending resolution of any inconsistent security procedures.

12 FAM 354  CONSTRUCTION SECURITY PLANS

OBO/CFSM/SM prepares construction security plans for projects initiated or controlled by the Department and the DS Physical Security Division (DS/PSP/PSD) approves them for subsequent certification action.  Once the project is certified, work may proceed within facilities containing CAAs.  A tenant agency prepares proposed plans for projects sponsored by that agency and forwards them to OBO/CFSM/SM for review.  OBO/CFSM/SM then forwards the plans to DS/PSP/PSD for approval.

12 FAM 355  TRANSIT SECURITY

a. CAA designated materials securely procured in accordance with 12 FAH-6 H-825.2 require subsequent secure transportation to post in accordance with 12 FAH-6 H-830.

b. Secure transportation is achieved when materials are continuously and positively controlled by U.S. citizens with at least a Secret-level clearance, or when technical devices approved and installed by DS continuously monitor them in accordance with 12 FAH-6 H-830 requirements.

12 FAM 355.1  Department-Initiated Plans

a. The construction security plan should include a general transit security plan.  Transit security plans may stand alone when they address the shipment of materials, items, or equipment for a CAA and do not relate to a construction project.

b. The Certification, Accreditation, Transit Security Branch (DS/PSD/CAT) must approve specific plans pertaining to individual shipments.

12 FAM 355.2  Container Certification Program

a. Containers must remain operable and meet minimum serviceability requirements that DS/PSD/CAT determines and approves.  OBO/CFSM/SM must obtain exact and specific container requirements from DS/PSD/CAT when formulating the construction security plans for projects.

b. The shipper must prepare containers for installation of technical devices as instructed by DS/PSD/CAT.  OBO/CFSM/SM must furnish these instructions to the originator/shipper in the construction contract.

c.  A container is certified when a DS/PSD/CAT-trained and -approved certification officer installs transit security countermeasures.

12 FAM 355.2-2  Decertification

The container is decertified when DS/PSD/CAT-trained individuals remove transit security countermeasures and/or devices from the container.   

12 FAM 355.2-3  Compromised Shipments

a. A certified shipment is compromised if:

(1)  control is lost;

(2)  the shipment deviates significantly from the approved transit security plan; or

(3)  the transit security countermeasures indicate evidence of tampering.

b. An escorted shipment is compromised if the shipment is out of the physical custody or direct observation of the escort personnel for any amount of time.

c.  Materials from compromised secure shipments are not authorized for storage in the Secure Storage Area  or use in the CAA unless granted specific approval from the Physical Security Division (DS/PSP/PSD) in accordance with 12 FAH-6 H-830.

12 FAM 355.2-4  Compromise Reporting

Personnel who suspect compromise of a shipment must report that information immediately to the DS Command Center (DS/TIA/CC), DS/PSP/PSD, and OBO/CFSM/SM.  If the compromise occurs at a foreign post, personnel must report it immediately to the OBO project SSM and the RSO.

12 FAM 356  SECURE LOGISTICS OPERATIONS

The Department encourages all posts and tenant agencies to use secure logistics operations (SLOs) services for U.S. Government shipments.  SLOs are DS-approved, Department-controlled operations that assist with secure procurement and coordinate secure shipments.
