(U) Form DS-82, U.S. Passport Renewal Application For Eligible Individuals

8 FAM 702.2-1 (U) Introduction
(CT:CITZ-101; 12-12-2023)
a. (U) U.S. citizens and non-citizen U.S. nationals are usually eligible to use the form DS-82 if:
(1) (U) The signed form DS-82 was received “not more than 15 years following the issue date of the previous passport” (per 22 CFR 51.21(b)(ii));
(2) (U) The applicant was at least 16 when their last passport was issued;
NOTE: (U) If the passport was limited with Endorsement 75 (see 8 FAM 505.2), they are not eligible to apply on the form DS-82. |
(3) (U) The applicant is using exactly the same name as on their most recent passport or submits legal documentation to show a material name change or a legal name change for what would otherwise be an immaterial name change (see 8 FAM 403.1 and 8 FAM 702.2-3);
(4) (SBU) The submitted passport was not altered, materially damaged, or mutilated (see 22 CFR 51.4(g)(4) and 8 FAM 902.2);
(5) (SBU) The applicant is readily identifiable from their previous passport records (see 8 FAM 401.3-1); and
(6) (U) The applicant has previously been issued a passport valid for 10 years (per 22 CFR 51.21(b)(1)). The submitted passport does not have to be valid for 10 years. You may accept a limited-validity passport with the form DS-82 if:
(a) (U) The applicant has at any point been issued a passport that is/was valid for 10 years; and
(b) (SBU) The submitted passport was limited-validity for any reason except for fraud or identity concerns (see 8 FAM 505.2 for guidance on specific limiting endorsements).
NOTE: (U) Applicants whose most recent passport was limited in validity because they submitted insufficient documentation with the previous application may only use a form DS-82 if they also submit acceptable documentation to overcome the issues from the previous application AND if the applicant has previously been issued a passport valid for 10 years. |
NOTE: (U) Special-issuance passports are limited only regarding entitlement (see 8 FAM 505.2-1), so a special-issuance passport may be used with the form DS-82 despite its validity period if the applicant is otherwise eligible to use the form DS-82. |
b. (U) To renew a valid (unexpired) passport, the applicant must submit that valid passport:
(1) (U) The requirement to submit the valid passport is waived for bearers of special-issuance passports who are overseas. The Special Issuance Agency (CA/PPT/SIA) will adjudicate the form DS-82 using the photocopy of their current special-issuance passport submitted by an authorized consular employee or the military acceptance agent;
(2) (U) The requirement to submit the valid passport is waived for the Military Fee Passport program; and
(3) (U) Passports that have been reported lost or stolen and subsequently recovered (i.e., found or recovered passports (see 8 FAM 902.4)), are not valid and cannot be used to apply on a form DS-82, even if expired.
c. (U) To renew an expired passport or apply for a passport of a different type, the applicant may submit:
(1) (U) Their most recent passport of the same type (e.g., the applicant submits an expired regular passport to apply for a regular passport); or
(2) (U) Their most recent passport of a different type, for example:
(a) (U) The applicant submits a passport card issued in 2022 to renew a passport book issued in 2012;
(b) (U) The applicant submits a special-issuance passport book to apply for any type of passport book and/or a passport card; or
(c) (U) A photocopy of their passport of any type when applying for a special-issuance passport.
d. (U) The form DS-82 may also be used to apply for a different type of passport for the first time (e.g., the applicant submits a regular passport to apply for a passport card).
e. (U) If an applicant is ineligible to apply with a form DS-82, you must suspend the form DS-82 and request that they re-apply on a form DS-11. When you receive an executed form DS-11, you must:
(1) (U) Apply the barcode when the application is approved in ACS (posts); or
(2) (U) Annotate the barcode number from the original form DS-82 in the barcode field of the form DS-11 (passport agencies/centers). Do not apply a second barcode to the form DS-11:
(2) (U) Annotate on the form DS-82 that a form DS-11 is attached:
(3) (U) Change the form type in TDIS from a form DS-82 to a form DS-11;
(4) (U) Enter the acceptance facility and acceptance agent numbers;
(5) (U) Follow the procedures in 8 FAM 702.1 to adjudicate the form DS-11, but stamp the form DS-82, because that is the application covered by the image blocking (see 8 FAM 1201.1-8); and
(6) (U) Assemble the application in the following order:
(a) (U) The form DS-82;
(b) (U) The form DS-11; and
(c) (U) All other attachments in accordance with 8 FAM 705.1.
d. (U) If an applicant submits a form DS-82 through direct mail but is eligible to apply on a form DS-5504:
(1) (SBU) You must consider whether it is in the best interest of the applicant to complete the form DS-5504 or proceed with the renewal. For example, if the applicant has less than one year of validity remaining or if the applicant has urgent or emergency travel, you should continue adjudicating the form DS-82;
(2) (SBU) If you determine that submitting a form DS-5504 is in the best interest of the applicant, you should suspend the form DS-82 to request the applicant complete a form DS-5504; and
(3) (U) When the completed form DS-5504 is received, you should attach it to the form DS-82 and refund the passport fees.
8 FAM 702.2-2 (U) Upper (Un-numbered) Section - Page One of the Form DS-82

(U) You must examine and adjudicate this section of the form DS-82 (i.e., the section with the instruction, "Please select the document(s) for which you are applying") the same as the form DS-11 (see 8 FAM 702.1-2).
8 FAM 702.2-3 (U) Numbered Items - Page One of the Form DS-82

a. (SBU) You must review the applicant's biographical information (name, date of birth (DOB), gender, place of birth (POB), and Social Security number (SSN)). Domestically, if the Travel Document Issuance System (TDIS) can verify that the biographical information on the application remains the same as the applicant’s previous application, a green check mark will appear next to the field. A red “x” will appear next to the field if TDIS cannot verify that the information remains the same. Written notations are not required for these items of the form DS-82 unless you are correcting or adding information on the application:
(1) (SBU) Occasionally, a red “x” will appear when there is no apparent change from the previous passport. When TDIS compares the biographical information, it does not compare punctuation. Consequently, TDIS will produce a red "x" for any name with an apostrophe or hyphen. Similarly, TDIS will occasionally "double" a name suffix, (e.g., Saul Panzer Jr Jr). Rarely, a red "x" will appear when there is no apparent change of any sort. In all of these cases, passport specialists must carefully review the biographical information, passport application, and previous passport to ensure that all of the information matches and make any corrections; and
(2) (SBU) The green check mark does not ensure that the information is correct, only that it matches the previous record. Thus, the green checkmark may appear because the same error was made on the previous record. The passport specialist must review the submitted passport to ensure that all the records are accurate.
b. (SBU) Any corrections to the applicant’s name, SSN, gender, DOB, POB, or additional names as entered in the system require that the application be re-cleared. Do not perpetuate errors from the previous application (see 8 FAM 1201.1). You may need to request additional evidence from the applicant to determine the correct information.
c. (U) The numbered paragraphs below correspond to the numbered items on page one of the form DS-82.
(1) (U) Name. Review the submitted passport to determine whether the names match. If they do not:
(a) (U) If a data entry error has occurred, correct the error in TDIS to agree with the data on the application;
(b) (U) Immaterial name changes, e.g., "John" to "Jon," may not be adjudicated on a form DS-82 (see 8 FAM 403.1). If the applicant requests an immaterial name change on a form DS-82, you must correct it to match the previous passport in accordance with 8 FAM 701.2 and enclose information notice (IN) IN-941-24. Written notations must be made on the application when correcting minor name discrepancies.
NOTE: (U) The applicant may not request an immaterial name change on a form DS-82 even if they also submit evidence of a material name change. For example, if Mary Anne Martin submits a court order changing her last name to James, she may not also use an initial in place of her middle name (unless the court order specifically states that is the new name). However, applicants whose names have changed as the result of marriage may use their previous last name as a middle name or add it as a second middle name. See 8 FAM 403.1-4(C)(1) regarding acceptable name changes by marriage. |
(c) (U) If the applicant is requesting a material name change, you must review:
(i) (U) Any acceptable name change documentation submitted with the Form DS-82 (see 8 FAM 403.1); or
(ii) (U) The Multiple Issuance Verification (MIV) record to see whether the applicant has changed their name on an application for a different type of passport (you may document the name change per the American Citizen Record Query (ACRQ)--see 8 FAM 1201.1)..
(d) (U) If the applicant is requesting a material name change but has not submitted acceptable name change documentation (see above), you must suspend the form DS-82 to request it.
(e) (U) You must annotate the applicant's name in accordance with the applicable procedures for this item in 8 FAM 702.1-3(A).
(2) (U) Date of birth. You must examine and adjudicate this item in accordance with the procedures in 8 FAM 702.1-3(B). However, written notations are only required if you are adding or correcting the date of birth;
(3) (U) Gender:
(a) (U) You must examine and adjudicate this item in accordance with the procedures in 8 FAM 702.1-3(C) and
(b) (U) Applicants may request a change to their gender marker on forms DS-11, DS-82, and DS-5504, if they are otherwise eligible to use that form. See 8 FAM 403.3 for further guidance; and
(c) (U) Domestically, if a correction is made to the gender field, TDIS automatically re-runs the application through Facial Recognition, so the application may need to be removed from the batch.
(4) (U) Place of birth: You must examine and adjudicate this item in accordance with the procedures in 8 FAM 702.1-3(D). Please note that the POB does not have to match the previous passport if the POB has had its name changed, e.g., the previous passport listed "Swaziland" and the applicant is requesting "Eswatini" (see 8 FAM 403.4). Written notations are only required if you are adding or correcting the place of birth;
(5) (U) Social Security number: You must examine and adjudicate this item in accordance with the procedures in 8 FAM 403.5;
(6) (U) Email address: You must examine and adjudicate this item in accordance with the procedures in 8 FAM 702.1-3(F);
(7) (U) Primary contact phone number: You must examine and adjudicate this item in accordance with the procedures in 8 FAM 702.1-3(G);
(8) (U) Mailing address: You must examine and adjudicate this item in accordance with the procedures in 8 FAM 702.1-3(H);
(9) (U) List all other names you have used: You must examine and adjudicate this item in accordance with the procedures in 8 FAM 702.1-3(I);
(10) (U) U.S. Passport information: If any items in this section are incorrect/incomplete, you must correct/complete them using the submitted previous passport(s) in accordance with 8 FAM 701.2. Do not suspend the form DS-82 solely because this information is incorrect/incomplete:
(a) (U) Notations must be made on the application if you are correcting or adding information to this section;
(b) (U) Check the expiration of the passport to ensure that the applicant submitted a full-validity passport. If the applicant submitted a limited-validity passport, you must determine why the passport was limited in validity. If the applicant was issued a limited-validity passport because of fraud or identity concerns, you must suspend the application and request that they reapply on a form DS-11 unless:
(i) (U) The reason for the limitation has been resolved on a subsequent application for another type of passport, e.g., the applicant was subsequently issued a full-validity passport card; or
(ii) (U) The applicant also submits acceptable documentation to overcome the issues that caused the need for limitation on the previous application, AND the applicant has previously been issued a passport valid for 10 years.
(c) (U) You must also annotate endorsement 09 (if applicable) and any endorsements that limited the validity period in the issue date block.
(11) (U) Name change information: If this item is incorrect/incomplete, you do not need to correct/complete it or suspend the application. Instead, you must document the name change information in the “For Issuing Office Only” block (see 8 FAM 702.2-6).

a. (U) You must examine and adjudicate this section of the form DS-82 the same as the form DS-11 (see 8 FAM 702.1-4).
b. (U) The applicant is required to provide a photograph with the form DS-82 in accordance with 22 CFR 51.21(c)(2). However, the applicant is not required to affix the photograph to the form DS-82. Consequently, passport agencies/centers and posts may need to affix the photograph to the form DS-82 (see the procedures for affixing the photograph in 8 FAM 702.1-4).
8 FAM 702.2-5 (U) Oath/Affirmation and Applicant Signature – Page One of the Form DS-82

a. (U) The applicant’s signature on the form DS-82 indicates affirmation of the oath (see 8 FAM 402.3 for further guidance on signatures). A signature by mark (see 8 FAM 402.3) is acceptable on a form DS-82 without requiring a form DS-71, Affidavit of Identifying Witness, if the applicant signed their previous passport application by mark. If the applicant signed their previous passport application with a traditional signature, then the applicant must re-apply on a form DS-11 to complete the signature by mark.
b. (U) You must examine and adjudicate the oath/affirmation and applicant's signature in accordance with the applicable procedures in 8 FAM 702.1-5(A).
c. (U) The signature date is used to determine whether:
(1) (U) The applicant is eligible to apply on a form DS-82. You must determine as of the date when the form DS-82 was received (unless there was a significant delay in mailing) whether the application was dated within 15 years of the issuance of the previous passport. If so, this eligibility requirement for applying on the form DS-82 is met;
(a) (U) The applicant is not eligible to apply on a form DS-82 if the date the applicant signed the form DS-82 is more than 15 years later than the issue date of the previous passport unless one of the exceptions below applies;
NOTE: (SBU) Limited Exception to the Issued within 15 Years Requirement: A supervisor or supervisory consular officer may accept a form DS-82 when the form DS-82 was made more than 15 years following the issue date of the previous passport if: · The applicant has emergency travel; · Completing and executing a form DS-11 is not feasible; and · The applicant is sufficiently identified with the previous passport. This exception must be used in extremely rare cases. |
(b) (U) If the applicant did not date the form DS-82, the applicant is not eligible to apply on a form DS-82 if the form DS-82 was entered into the system more than 15 years following the issue date of the previous passport (per the trace screen in ACRQ). Otherwise, the form DS-82 is acceptable without the signature date.
(2) (U) The photograph is more than six months old and a new photograph is needed (see 8 FAM 402.1).

a. (U) This area is reserved for you to record the disposition of the submitted passport(s), name change information provided by the applicant, documents submitted with the form DS-82, and your approval of the form DS-82.
b. (U) Disposition of the submitted passport(s):
(1) (U) If you are suspending the form DS-82 for any reason, do not cancel submitted passport(s); and
(2) (U) If the applicant submitted a passport that already has been canceled, they may not have submitted their most recent passport.
(a) (U) You must review the applicant’s passport history in MIV/ACRQ. If another type of passport was issued to the applicant after the issuance of the submitted canceled passport, e.g., the applicant applied for a passport card using their previous passport book, this may be acceptable, depending on the reason the passport was canceled; and
(b) (U) Otherwise, you must suspend the application and send the applicant an appropriate IRL to request the most recent passport.
(3) (U) PPT BK C/R: Place a checkmark in this checkbox if you are canceling and returning the submitted passport book to the applicant (see 8 FAM 901.1);
(4) (U) PPT BK S/R: Place a checkmark in this checkbox if you are returning the submitted passport book to the applicant without canceling it;
(5) (U) PPT CD C/R: Place a checkmark in this checkbox if you are canceling and returning the submitted passport card to the applicant (see 8 FAM 901.1); and
(6) (U) PPT CD S/R: Place a checkmark in this checkbox if you are returning the submitted passport card to the applicant without canceling it.
c. (U) Marriage certificate: If the applicant submits an acceptable marriage certificate (see 8 FAM 403.1), you must:
(1) (U) Check the “Marriage Certificate” checkbox;
(2) (U) Annotate the date of marriage and place issued (city/county and state; or city/foreign country);
(3) (U) Annotate both the pre-marital name in the “From” line; and either;
(4) (U) Annotate the spouse's name in the “To” line if the marriage certificate does not explicitly list the new married name, or
(5) (U) Annotate the married name in the "To" line if the marriage certificate expressly lists the married name:
d. (U) Court order: If the applicant submits an acceptable court order (court orders include divorce decrees—see 8 FAM 403.1), you must:
(1) (U) Check the “Court Order” checkbox;
(2) (U) Annotate the date the order was filed, docket or file number, the location of the court (city/county and state; or city and country of issuance); and
(3) (U) Annotate both the previous name and current name on the “From” and “To” lines.
e. (U) Other:
(1) (U) If the applicant submits a deed poll, you must:
(a) (U) Check the “Other” checkbox;
(b) (U) Annotate that a deed poll was submitted;
(c) (U) Annotate the date of the deed poll, docket or file number, and the location (city/county and state; or city and country of issuance); and
(d) (U) Annotate both the previous name and current name on the “From” and “To” lines.
2(U) If the applicant submits a naturalization certificate (which may occur if they were non-citizen U.S. nationals who naturalized after the issuance of their previous passport), you must annotate the same information as is required in 8 FAM 702.1-9(C):
(3) (U) If you enclose an IN, you must annotate the IN number in this space.
f. (U) Attached: This space is for annotating any document that you are retaining with the form DS-82 (see 8 FAM 702.1-9(G) for further guidance on attaching items). For example:
(1) (U) If you receive a letter from the applicant, you must check the “Attached” checkbox, annotate that a letter was received, and briefly describe its subject:
(2) (U) You must attach IRLs, overseas post requests for additional applicant information, and denial letters in accordance with the policy on attaching IRLs in 8 FAM 702.1-9(H). You must check the “Attached” checkbox and annotate that an IRL is attached:
(3) (U) If the applicant submits a photocopy of their identification document (ID) you must retain it with the Form DS-82. You must check the “Attached” checkbox and annotate that a photocopy of the ID is attached:
(4) (U) If the applicant submits a photocopy of their evidence of citizenship, you must retain it with the form DS-82. You must check the “Attached” checkbox and annotate that a photocopy of the citizenship evidence is attached:
g. (U) Application approval box: Stamp and sign in the application approval block on the bottom right of page one of the form DS-82, indicating approval, in accordance with 8 FAM 702.1-9(I).

(U) While most of the information on page two of the form DS-82 is not strictly material to the adjudication of citizenship, identity, or entitlement, you should consider the information as part of the totality of an applicant's eligibility. You may approve a form DS-82 despite an incomplete, missing, or blank second page if there are no fraud indicators.
